Have you put anything in writing to them?..if you havent, then do so and give them reasonable time to repond..2 weeks is plenty long enuff.Put everything down. Quote
Guest bigal Posted October 20, 2006 Report Posted October 20, 2006 Thanks for replies. mumof4 I didnt go back to garage at first, because when i had problem with the cruise control they didnt want to know, at this point i didnt know my rights. It wasnt until after i had the gearbox replaced and tried without success to claim on the warranty i bought, that i was informed by trading standards of my rights. Suddenly they have changed there minds and said they cant go any further with my case. I cant see how TS can be on my side when the garage is a member of their organisation. I have written to the garage on a few occasions and had only had one reply, basically saying we are sorry you are having problems with your car but we did offer you a warranty (which is complete c**p). Today was the only time i had spoken face to face with the MD, who seemed quite a nice bloke. suzuki91 I think if i took anyone it would be the wife, she scares the s**t out of me. :D Whats bothering me is why does it matter who fixed the car, the problem was still there and the place i got it fixed was the same one the garage i bought it from would have used. Sorry for the rant i am just fed up with it all its being going on for ages now. Thanks again for your replies. :angry: Quote
anadin Posted October 20, 2006 Report Posted October 20, 2006 yes you must give the garage the opportunity to fix it , but you did notify them and the md was on holiday , you took it to their approved repairer , as instructed by the salesman :angry: , its up to you bigal , i would persue but you could approach the md in writing for half the cost, it was only nine days into ownership, good luck anyway :D Quote
Guest seacam Posted October 20, 2006 Report Posted October 20, 2006 Hello Bigal, I'm afraid in this instance you haven't a leg to stand on and I fear would be unsuccessful in the small claims court no matter how sympathetic they might be towards you. I could tell you where you went wrong but you know this, as you state, you are aware of your rights now. Statuary guarantees are just that and give you a lot of protection and hopefully so will some warrantees after an innical period, in Warranty Direct case, 90 days. Even if none of these had been in place you might still have been able to make a successful claim had you been able to show, ( and the reasons why ), the gear box went wrong, this would have entailed getting an independent report on the box. Even then who would the claim be against?, depending on the mileage of the vehicle and other factors, either the dealer or Ford themselves in certain circumstances. I take it your Galaxy had a previous owner/s, under certain circumstances, in theory anyway, this fact would have no relevance. If you could have shown there was a manufacturing fault with your gearbox that must have been in existence from new and one could have reasonably expected it to last longer then it did, I think you would have had a strong case against Ford. If you buy a washing machine with guaranteed parts and labour for two years and two years nine months later the motor is screwed you may well still be able to get your machine fixed free or at a greatly reduced cost depending on why the motor went bust. However it is quite clear in law, ( except where the seller is no longer in existence ), you must give the seller, manufacture a chance to repair their/your item and you to be able to show this or any refusals. You can't just get it repaired elsewhere and ask them to cough up even tho' under the circumstances I fully understand why you went elsewhere for a repair. If the dealer is making you an offer, IMO take it, they don't have to. This post doesn't help much and it's a bitch when it happens, you have my heart felt commiseration's. For what it worth I recently went through this same legal issue on my low mileage last vehicle, diesel pump, injectors and so on needed to be replaced ( I was the third owner ), I had a partial victory, ( two thirds costs to me ), but I still feel pissed off about it, it was a clear manufacturing fault but I knew my rights and gave them options but at first they washed their hands.
